1) Identity of the Application's Owner

2) Purpose
The aim of this Application is to provide more security in the process of allowing access to the residential complex's premises by guests of the owners or other third parties. Similarly, owners can use the Application to check their accounts, pay bills or reserve other services, e.g. green fees.

3) Application Use License
MHP is the owner of all rights to the Application and, in this respect, grants the user only the right to use it in accordance with the uses for which it has been designed and, in particular, in accordance with the provisions of our Terms of Use and/or applicable law. By downloading, installing and/or using the Application, you will not acquire any ownership rights to the Application.

Likewise, we inform you that, at any time, you can uninstall the Application from your device through its various configuration options.

This License does not grant any right to obtain future versions, updates or upgrades to the Application . However, if updates, new versions or upgrades are obtained, the use of such new versions or upgrades shall be governed by this agreement and any amendments thereto, unless other conditions exist for the new versions, updates or upgrades, in which case such conditions shall apply.

4) User’s Acceptance
These Terms of Use govern the access and use of the application (the "Application") that MHP makes available to Internet users. Therefore, by installing the Application, the user accepts its Terms of Use. If not, the user should not use it and should proceed to uninstall it from his terminal.

Through the Application, MHP can offer services that may be subject to specific conditions, of which the User will be informed in each specific case.

This Application may evolve and therefore the form or nature of the Application may change from time to time without prior notice. In addition, MHP may temporarily or permanently discontinue the use of the Application (or any of its features) by you or all users generally, and in these circumstances, it may happen that you cannot be notified in advance.

5) Access to the Application
Access to the Application is granted to the user upon request by email or telephone. Once the request has been analyzed and verified, a link will be sent, through which the Application can be downloaded and may require the entry of personal data necessary for it to function properly. With your consent and on a voluntary basis, data can also be collected from the device's photo camera and its image gallery, so that if you wish, you can complete your registration process by adding your photograph.

Similarly, by accepting these Terms of Use, the User authorizes that any data that may already be in the possession of any of the persons designated in the privacy policy may be completed or self-completed by the Application itself.

6) Correct Use of the Application
The User agrees to use the Application, contents and services in accordance with the Law, these Terms of Use, good customs and public order. Similarly, the User agrees not to use the Application, its contents or the services provided through it for purposes or effects that are illegal or contrary to those stated herein, harmful to the interests or rights of third parties, or that in any way may damage, disable, make inaccessible or deteriorate the Application, its contents or services or prevent normal enjoyment of it by other Users.

Furthermore, the User expressly agrees not to destroy, alter, disable or in any other way damage the data, programs or electronic documents that are in the Application.

The User agrees not to hinder the access of other Users through the massive consumption of the computer resources through which MHP provides the service, as well as not to carry out actions that damage, interrupt or generate errors in said systems or services.

The User agrees not to introduce or input programs, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or are likely to cause any alteration in the computer systems of MHP or third parties.

7) Advertising
Part of the Application can host advertising content or be sponsored. Advertisers and sponsors are solely responsible for ensuring that material submitted for inclusion in the Application complies with applicable laws.

8) Third-Party Links
These Terms of Use relate only to the Application and contents of MHP, and do not apply to links or third party websites accessible through the Application.

The linked sites are not under the control of MHP, and MHP is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites.

These links are provided solely to inform the User of the existence of other sources of information on a particular topic, and the inclusion of a link does not imply endorsement of the linked website by MHP.

9) Intellectual and Industrial Property
Unless otherwise indicated, all of the Application’s contents are licensed or owned exclusively by MHP, including, but not limited to, the graphic design, source code, logos, text, graphics, illustrations, photographs, and other elements that appear on the Application.

Moreover, all commercial names, brands or distinctive signs of any kind contained in the application are protected by law.

MHP does not grant any type of license or authorization for personal use to the User concerning their intellectual and industrial property rights or any other rights related to its Application and the services offered therein.

Therefore, the User recognizes that the reproduction, distribution, commercialization, transformation, and in general, any other form of exploitation, by any procedure, of all or part of the contents of this Application constitutes an infringement of the intellectual and/or industrial property rights of MHP or the owner of these rights.

10) Personal Data Protection
Users may send MHP their personal data through the different forms they have filled out in order to access the application. Furthermore, the User authorizes the management company of the Residential Complex to provide the owner of the Application with the minimum essential data required by the app for its installation or operation, such as identification data, services provided, invoices paid or pending payment and/or bank details. The aforementioned forms will incorporate a legal text on personal data protection that complies with the requirements established in REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016, in Organic Law 3/2018, 5 December, on the protection of personal data and guaranteeing of digital rights, or in any other law that replaces the foregoing regulations.

11) Modification of the Terms of Use

12) Applicable Law and Jurisdiction
The relationship between MHP and the User will be governed by the Spanish regulations in force. Any dispute over its interpretation and application will be submitted to the Spanish Courts and Tribunals, with express waiver by the User to any other jurisdiction that may apply.
